    General Information Utility|Pay has drafted this Privacy Statement to explain how Utility|Pay, as Data Controller, may collect, store, process, share and transfer the User's Personal Data when the User visits the Sites or uses

    Utility|Pay services. This Privacy Statement applies to the User's Personal Data when the User visits the Sites or uses the Services, but does not apply to Sites or Online Services that are not owned by Utility|Pay or controlled by Utility|Pay, including the Sites or Services of other Utility|Pay Users.

    This Privacy Statement has been drafted to inform you about Utility|Pay's privacy practices and the privacy options available when using the Utility|Pay Sites and Services. It is important to remember that the Services offered by Utility|Pay may vary depending on the geographical area. This Privacy Statement may be supplemented by other policies depending on the Sites and Services concerned.     A definition is provided for certain terms used in this Privacy Statement. The meaning of capitalized terms is available in the Definitions section.

    2 . What personal data does Utility|Pay collect?

    When the User visits the Sites or uses the Utility|Pay Services, the User's Personal Data is collected, including the following: Registration and usage information: when the user registers

    • Sending money: When the user sends money through the Services, Utility|Pay collects Personal Data such as name, address, telephone number, and financial data from the account of the participant who receives the money from the user or who sends it to him. The Personal Data requested about the participant may vary depending on the Services used to send or request money.
    • Pay
    • or ask another person to pay an invoice: If the User uses the Utility|Pay Services to pay an invoice on behalf of another person or asks another User to pay an invoice for them, Utility|Pay collects from the User the Account Holder's Personal Data, such as name, address, telephone number, email address and account number of the bill that the User intends to pay or asks someone else to pay.
    • Recharge accounts: if the user uses the Utility|Pay services to recharge their Account or any other account they own, or if they ask another user to recharge one of these accounts, to simplify the operation, Utility|Pay can obtain the Personal Data of the other party involved in the transaction directly from the user, or vice versa.
    • Personal data that the user chooses to provide to Utility|Pay to obtain additional Services or specific online Services: if the user requests or participates in an optional functionality of the Site or requires Advanced Services or other functions of their choice, Utility|Pay may collect additional information from the user. If the use of Personal Data differs from what is indicated in this Privacy Statement, Utility|Pay will provide the user with a separate notice at the time of collecting such data.
    • Personal Data about the User from third parties: Utility|Pay receives information from third parties, including partners, data providers and credit agencies, where permitted by law.
    • Other information collected in connection with the use of Utility|Pay Sites or Services: Utility|Pay may collect additional information from the User or the User when the User communicates with Utility|Pay, contacts the Utility|Pay customer support teams, or responds to a survey.

     

    3 . Why does Utility|Pay store personal data?

    Utility|Pay stores Personal Data in an identifiable format for the minimum period necessary to comply with legal or regulatory obligations and for its business purposes. Utility|Pay may keep Personal Data for longer periods of time than those required by law, where this is in its legitimate business interest and is not prohibited by law. If the user's Account is closed, Utility|Pay may obfuscate Personal Data and other information, but reserves the right to keep and access them for as long as necessary to ensure compliance with applicable laws. Utility|Pay will continue to use and disclose such Personal Data in accordance with this Privacy Statement.

    The cookies used by Utility|Pay have defined deadlines; unless the user visits the Sites or uses the Utility|Pay Services within that time limit, cookies will be automatically disabled and the stored data will be deleted.     4 . How does Utility|Pay process personal data?

    Utility|Pay may process the User's Personal Data for a variety of reasons justified by data protection regulations in the European Economic Area (EEA) and Switzerland.

    • To manage the Sites and provide the Services, including : initiate

      • a payment, send money, fund an account or pay an invoice; authenticate
      • the User's access to an Account; communicate
      • with the User regarding the Account, Sites or Services, create
      • a link between the User's Account and a third-party account or platform; perform
      • credit
      • checks and other financial checks, evaluate applications and compare data to verify accuracy;
      • keep financial data and User Account information up to date.
    • To manage Utility|Pay's business needs, including monitoring, analyzing and optimizing the performance and functionality of the Sites and Services. For example, Utility|Pay analyzes User behavior and researches how the User uses the Services.
    • To manage risks and protect the Sites, Services and the User from fraud, verifying the identity of the User. Utility|Pay's risk and fraud prevention tools use Personal Data, Device Information, Technical Usage Data and Geolocation Information of Sites and websites that offer Utility|Pay Services to allow detection and prevention of fraud, as well as the misuse of the Services.
    • To comply with Utility|Pay's obligations and apply the terms of the Utility|Pay Sites and Services, as well as to comply with all applicable laws and regulations.
    • For the legitimate interests of Utility|Pay, including:
      • applying the terms of the Utility|Pay Sites and Services;
      • managing the daily business needs of Utility|Pay, such as monitoring and analysis; managing risks, fraud and misuse of the
      • Utility|Pay Services; anonymizing
      • Personal Data to provide aggregated statistical data to third parties, including other companies and customers, on how, when and why Users visit the Sites and use the Utility|Pay Services; and
      • carry out business-to-business marketing activities; and provide
      • personalized Services (also called personalized advertising) offered by Utility|Pay on third-party websites and online services. Utility|Pay may use your Personal Data and other information collected in accordance with this Privacy Statement to provide you with targeted views, functionality or offers on third-party websites.
    • With the User's consent, also:
      • To market Utility|Pay and other independent companies' products and services. Utility|Pay may also process the user's Personal Data to personalize marketing content and certain Services or experiences on the Site, to better adapt them to the user's interests on the Utility|Pay and other third party websites.
      • To use cookies or other tracking technologies to offer the User targeted views, functionality, offers or Services and/or to collaborate with third parties, such as vendors, advertising agencies or analysis companies to provide these personalized services (also referred to as personalized advertising).
      • To provide options, functionality or offers specific to a particular location, if the user chooses to share their geolocation information through the Services. Utility|Pay will use this information to improve the security of its Sites and Services, as well as to provide the user with location-based Services, such as advertisements, search results and other personalized content (also referred to as personalized advertising).

    The user can revoke their consent at any time and without incurring any cost. For more information on how to proceed, see the section on privacy options.

     

    5 . Does Utility|Pay share personal data?

    Utility|Pay may share Personal Data or other User information with third parties in a variety of ways, as described in this section of the Privacy Statement. Utility|Pay may share Personal Data or other information for the reasons set out below.

    With other members of the Utility|Pay Corporate Group: Utility|Pay may share the User's Personal Data with members of the Utility|Pay corporate group to provide, among others, the Services requested or authorized by the User; to manage risks; to detect and prevent potentially illegal and fraudulent acts and other violations of Utility|Pay rules and agreements and to better manage the availability and connectivity of Utility|Pay products, Services and communications.

    With other companies that offer services to Utility|Pay: Utility|Pay shares Personal Data with third-party service providers that offer services and functionality on behalf of Utility|Pay. These third-party service providers may, for example, provide Services to you, verify your identity, provide assistance with processing transactions, send you advertising on Utility|Pay products and Services, and provide customer support.

    With financial institutions: Utility|Pay shares Personal Data with financial institutions with whom it collaborates to jointly create and offer products. These financial institutions may only use this information to market and offer products related to Utility|Pay, unless the user has authorized its use for other purposes. Utility|Pay may also share your Personal Data to process transactions, provide benefits associated with your eligible cards, and keep your financial information up to date.

    With the User's counterparties in transactions related to the use of the Services, that is, other Users, partners and service providers, :Utility|Pay may share the User's information and his Account with the counterparties involved in the processing of transactions. Counterparties include other people who send money to the User or receive money from the User, partners and service providers. The information may include:

    • Personal and Account Data necessary to carry out the transaction;
    • Personal Data to help other participants resolve disputes, as well as detect and prevent fraud; and Analysis of anonymous data and
    • performance to allow sellers to better understand the dynamics of using the Utility|Pay Services and improve the User experience.

    With other third parties for commercial purposes or as permitted or required by law: Utility|Pay may share User data with third parties for commercial purposes of Utility|Pay or as required or permitted by law, including: if necessary to comply with the law, legal process or regulations in force; competent authorities or other public officials or with third parties based

    • on a
    • subpoena, court order, or other legal process or requirement applicable to Utility|Pay or the Utility|Pay corporate group;
    • if Utility|Pay believes, at its discretion, that the disclosure of Personal Data is necessary or appropriate to avoid physical harm or financial loss or in connection with an investigation of suspected or actual illegal activities;
    • to protect the fundamental interests
    • of an individual; with credit reporting agencies and data processors
    • data to carry out global debt checks and for the purpose of combating fraud and compliance checks; to
    • investigate violations of the Terms of Use or other legal conditions applicable to any Service or to ensure their application; to protect the property, Services and legal rights of Utility|Pay;
    • in relation to services related to the use of a
    • Service; to facilitate
    • risk assessment and management, as well as the prevention of fraud against Utility|Pay and Utility|Pay Users and fraud that occurs on the Utility|Pay Sites or that concern the use of Utility|Pay Services, including those involving Utility|Pay's business partners, strategic business initiatives or other individuals;
    • banking partners, as required by the regulations on the association of payment cards, for inclusion in the list of partners with whom relationships have been resolved; with the companies of
    • reporting and debt collection;

    Prior consent of the User: Utility|Pay will also share Personal Data and other information with the User's consent or at the direction of the User, even when the User authorizes the connection of a Utility|Pay account to a third-party account or platform.

    Utility|Pay does not share Users' Personal Data with third parties for marketing purposes related to those parties without the user's consent.

     

    6 . How does Utility|Pay interact with other services and platforms?

    A significant advantage as well as a novelty of the Utility|Pay Services is the possibility for the user to connect their Account to a platform or to a third-party account or account. For the purposes of this Privacy Statement, an 'account link' with a third party is a link that the user authorizes or enables between their Utility|Pay Account and another non-Utility|Pay account, account, payment method or platform that the user legitimately manages or owns. If the user authorizes such a link, Utility|Pay and the third party will directly exchange the user's Personal Data and other information. Examples of account connections:

    • connecting the User's Account to a third party that deals with data aggregation or financial services, if the User provides that company with the credentials to access their Account; or using the User's Account to make payments or
    • to allow a payment to be debited from the User's Account.

    If the user decides to link the Account, Utility|Pay may receive information from the third party about the user and his use of the third party's service. If the user connects their Account to other financial accounts, directly or through a third-party service provider, Utility|Pay can access the user's account balance and transaction data, such as purchases and money transfers. Utility|Pay will use all information received from third parties through account links in accordance with this Privacy Statement.

    The information that Utility|Pay shares with third parties following an account link will be used and disclosed in accordance with the privacy policies of the relevant third parties. Before authorizing an account link, the user is required to read the privacy policy of all third parties that have authorized the connection and who, by virtue of it, will be able to access the user's Personal Data. For example, the Personal Data that Utility|Pay shares with a third-party platform, account, or account, such as a social account, may in turn be shared with other parties, including the general public, based on the privacy policies of the account, account, or platform.

     

    7 . How does Utility|Pay use cookies and tracking technologies?

    When the user visits the Sites or uses the Utility|Pay Services or visits a third-party website to which Utility|Pay provides online services, Utility|Pay, its business partners and its suppliers may use cookies and other tracking technologies (collectively referred to as' Cookies') to recognize the user and personalize their online experience, the Services they use and other online content and advertising, to measure the effectiveness of promotions and perform analysis, as well as to reduce risks, prevent potential fraud and promote trust and security in the Utility|Pay Sites and Services. Some aspects and functionality of the Utility|Pay Sites and Services are available only through the use of cookies. If the user decides to disable or reject cookies, the use of the Sites and Services may be limited or unavailable.

    Do Not Track (DNT) is an optional browser setting that allows the user to set their preferences regarding the tracking of advertisers and other third parties. Utility|Pay does not respond to DNT signals.

    8. What options does the user have with regard to privacy?

    The user has certain options in relation to the privacy procedures and communications described in this Privacy Statement. Many of these options are explained when the user registers or when using a Service or Site. While browsing the Services, the user may receive instructions and requests.

    • Options related to Personal Data collected by Utility|Pay
      • Personal Data. The user can refuse to provide the Personal Data requested by Utility|Pay. In this case, however, you may not have access to some or all of the Services.
      • Location and other device-level information. The device used to access the Sites or Services may collect information about the user, including geolocation information and user usage data, which Utility|Pay can then acquire and use. For information on whether you can limit the collection and use of this information, refer to the settings available on your device.
    • Options related to the use of Personal Data by Utility|Pay
    • Account link options
      • If you authorize the connection of your Account to a third-party platform, account or account, you may be able to manage your connection preferences from your Account or from the third-party platform, account or account.     • Choices related to cookies
      • There may be options available to manage user preferences in relation to cookies.       • Utility|Pay may send the user marketing content regarding its Sites, Services, products, products offered together with financial institutions, as well as products and services of independent third parties and members of the Utility|Pay corporate group through various communication channels, such as email, SMS, pop-ups, push notifications and messaging applications. The user can choose to stop sending such marketing communications by Utility|Pay by following the instructions contained in the communications themselves. If you have a Utility|Pay Account, you can also change your communication preferences in your Account Settings. With regard to messages sent through push notifications, the user can manage preferences on their device.
      • Information and more: the user will receive all the necessary communications that Utility|Pay is required to send to users of its Services, notifications containing important information and other communications requested by the user to Utility|Pay. The user cannot choose not to receive these communications, however, they can change the medium and format in which they receive them.

     

    9 . What are the user's rights?

    In accordance with the limitations established by the data protection legislation of the European Economic Area, the user has certain rights regarding their Personal Data. In particular, the user has the right to access, rectification, limitation, cancellation and portability of data. To exercise these rights, the user can contact Utility|Pay.

    In addition, subject to certain specific requirements, the user has the right to object to the processing of their Personal Data based on legitimate interests or a public interest or the exercise of public authority vested in Utility|Pay.

    If you have an Account for one of the Utility|Pay Services, you can generally check and modify your Personal Data in the Account by logging in and updating the information directly. Utility|Pay may use automated decision-making processes for credit issues with the user's consent, where necessary for the conclusion or fulfillment of a contract or where authorized by a law of the European Union or a member state of the European Union.

    10 . How does Utility|Pay protect the user's personal data?

    Utility|Pay adopts technical, physical and administrative security measures designed to ensure adequate protection of the user's Personal Data against loss, misuse, unauthorized access, disclosure and modification. These security measures include firewalls, data encryption, physical access controls to Utility|Pay data centers, and verification of information access permissions. Although Utility|Pay is committed to protecting its systems and Services, the user is responsible for protecting and maintaining the privacy of their passwords and account or profile registration data, as well as for verifying that their Personal Data acquired by Utility|Pay is correct and updated. Utility|Pay is not responsible for the protection of Personal Data shared with third parties following an account link authorized by the user.

     

     

    12 . Account Definitions

    • : A Utility|Pay user account.

    • Data Controller: Utility|Pay determines the purposes and tools for the Processing of Personal Data.

    • Device Information: data that can be automatically collected from any device used to access the Site or Services. This information may include, but is not limited to, the type of device, device network connections, device name, device IP address, information about the web browser and the device's Internet connection used to access the Site or Services, geolocation information, information about apps downloaded to the device, and biometric data.

    • Geolocation information: information that indicates, with reasonable specificity, the User's position, for example, through the latitude and longitude coordinates obtained through the triangulation of the GPS site, Wi-Fi or cell.

    • Utility|Pay: means Utility|Pay, Inc. and its affiliated or affiliated companies. In this Privacy Statement, Utility|Pay is sometimes referred to as the first person plural, depending on the context.

    • Personal data: information that may be associated with an identified or directly or indirectly identifiable natural person. 'Personal Data' may include, but is not limited to, name, address (including billing and shipping addresses), telephone number, email address, credit or debit card number, other financial account information, account number, date of birth, and credentials issued by authorities (for example, driver's license number, ID number or passport number).

    • Process: any method adopted by Utility|Pay to manage Personal Data or sets of Personal Data, with or without the aid of automated procedures, such as collection, registration, organization, structuring, storage, adaptation or modification, retrieval and consultation, disclosure by transmission, dissemination or any other method to make them available, alignment or combination, restriction, cancellation, or the deletion of Personal Data.

    • Services: any product, service, content, feature, technology or functionality, as well as all related websites, applications and services offered to the User by Utility|Pay.

    • Sites: the websites, mobile apps, official social media platforms, or other online properties through which Utility|Pay offers the Services and where this Privacy Statement is published directly or available through a link.

    • User: an individual who uses the Services or accesses the Sites.
