1. General information

Utility|Pay has drafted this Privacy Statement to explain how Utility|Pay, as a Data Controller, may collect, store, process, share, and transfer the Personal Data of the User when the latter visits the Sites or uses the Services of Utility|Pay. This Privacy Statement applies to the User's Personal Data when visiting the Sites or using the Services but does not apply to online sites or services that are not owned or controlled by Utility|Pay, including sites or services of other Users of Utility|Pay.

This Privacy Statement has been prepared to inform the user about the procedures adopted by Utility|Pay to protect privacy and the options available regarding privacy when using Utility|Pay Sites and Services. It is important to note that the services offered by Utility|Pay may vary depending on the geographical area. This Privacy Statement may be supplemented by other information depending on the relevant Sites and Services. For some terms used in this Privacy Statement, a definition is provided. The meaning of terms with initial capital letters is available in the Definitions section.

2. What personal data does Utility|Pay collect?

When the User visits Utility|Pay Sites or uses Utility|Pay Services, the User's Personal Data is collected, including the following:

  • Registration and Usage Information: When the user registers to use Utility|Pay Services and creates an ID, Utility|Pay collects the necessary Personal Data for the provision of the requested Services. Depending on the chosen Services, to proceed with the creation of an Account, Utility|Pay may ask the user to provide name, address, phone number, email address, and identifying information. During the use of Utility|Pay Services, the user may be required to provide additional Personal Data.

  • Transaction and Experience Information: When the User uses Utility|Pay Services or accesses Utility|Pay Sites, such as registering new customers, checking their position, processing payments, seeking assistance, Utility|Pay collects information about the registration to be made, the data consulted and modified, any information related to the payment transaction, as well as Device Information, Technical Usage Data, and Geolocation Information.
  • Personal Data of Participants: When the User uses Utility|Pay Services or accesses Utility|Pay Sites, Personal Data provided by the User about other participants associated with the transaction is collected.
  • Send Money: When the user sends money through the Services, Utility|Pay collects Personal Data such as the name, address, phone number, and financial data of the participant receiving money from the user or sending it to them. The required Personal Data regarding the participant may vary depending on the Services used to send or request money.
  • Pay or Ask Someone to Pay a Bill: If the User uses Utility|Pay Services to pay a bill on behalf of another person or asks another User to pay a bill on their behalf, Utility|Pay collects the User's Personal Data, such as the account holder's name, address, phone number, email address, and invoice account number that the User intends to pay or asks someone else to pay.
  • Recharge Accounts: If the user uses Utility|Pay services to recharge their own account or any other account they own, or if they ask another user to recharge one of those accounts, to simplify the operation, Utility|Pay may obtain Personal Data directly from the user about the other party involved in the transaction, or vice versa.
  • Personal Data User Chooses to Provide to Obtain Additional Utility|Pay Services or Specific Online Services: If the user requests or participates in an optional feature of the Site or requests advanced services or other features of their choice, Utility|Pay may collect additional information from the user. If the use of Personal Data differs from what is indicated in this Privacy Statement, Utility|Pay will provide the user with a separate notice at the time of collecting such data.
  • User's Personal Data from Third Parties: Utility|Pay receives information from third parties, including partners, data providers, and credit agencies, where permitted by law.
  • Other Information Collected in Connection with the Use of Utility|Pay Sites or Services: Utility|Pay may collect additional information from or about the User when they communicate with Utility|Pay, contact Utility|Pay customer support teams, or respond to a survey.

 

3. Why does Utility|Pay store personal data?

Utility|Pay retains Personal Data in an identifiable format for the minimum period necessary to fulfill legal or regulatory obligations and for its business purposes. Utility|Pay may retain Personal Data for longer periods than required by law, where it is in its legitimate business interest and not prohibited by law. If the user's Account is closed, Utility|Pay may proceed to obscure Personal Data and other information, but reserves the right to retain and access them for as long as necessary to ensure compliance with applicable laws. Utility|Pay will continue to use and disclose such Personal Data in accordance with this Privacy Statement.

The cookies used by Utility|Pay have defined expiration dates; unless the user visits Utility|Pay Sites or uses Utility|Pay Services within that time limit, cookies will be automatically disabled, and stored data will be deleted. 4. How does Utility|Pay process personal data?

Utility|Pay may process the User's Personal Data for various reasons permitted by data protection regulations in the European Economic Area (EEA) and Switzerland.

  • To manage the Sites and provide Services, including:

    • initiating a payment, sending money, recharging an account, or paying a bill;
    • authenticating the User's access to an Account;
    • communicating with the User regarding Account, Sites, or Services;
    • creating a link between the User's Account and a third-party account or platform;
    • conducting solvency checks and other financial verifications, evaluating applications, and comparing data for accuracy;
    • keeping financial data and information about the User's Account up-to-date.
  • To manage Utility|Pay's business needs, including monitoring, analyzing, and optimizing the performance and features of the Sites and Services. For example, Utility|Pay analyzes User behavior and conducts research on how Users use the Services.
  • To manage risks and protect the Sites, Services, and the User from fraud by verifying the User's identity. Utility|Pay's tools for risk and fraud prevention use Personal Data, Device Information, Technical Usage Data, and Geolocation Information from Utility|Pay Sites and websites offering Utility|Pay Services to enable fraud detection and prevention, as well as misuse of the Services.
  • To comply with Utility|Pay's obligations and enforce the conditions of Utility|Pay Sites and Services, as well as to comply with all applicable laws and regulations.
  • For Utility|Pay's legitimate interests, including:
    • enforcing the conditions of Utility|Pay Sites and Services;
    • managing Utility|Pay's daily business needs, such as monitoring and analysis;
    • managing risks, fraud, and misuse of Utility|Pay Services;
    • anonymizing Personal Data to provide aggregated statistical data to third parties, including other businesses and customers, on how, when, and why Users visit Utility|Pay Sites and use Utility|Pay Services; and
    • conducting business-to-business marketing activities; and
    • providing personalized Services (also known as personalized advertising) offered by Utility|Pay on third-party websites and online services. Utility|Pay may use the User's Personal Data and other information collected in accordance with this Privacy Statement to provide the User with targeted views, features, or offers on third-party websites.
  • With the User's consent, also:
    • To market Utility|Pay's products and Services and those of other independent companies. Utility|Pay may also process the User's Personal Data to personalize marketing content and certain Services or experiences on the Site to better align them with the User's interests on Utility|Pay websites and other third-party sites.
    • To use cookies or other tracking technologies to provide the User with targeted views, features, offers, or Services and/or to collaborate with third parties, such as vendors, advertising agencies, or analytics companies, to provide these personalized services (also known as personalized advertising).
    • To provide options, features, or offers specific to a particular location, if the User chooses to share their geolocation information through the Services. Utility|Pay will use such information to enhance the security of its Sites and Services, as well as to provide the User with location-based Services, such as advertising, search results, and other personalized content (also known as personalized advertising).
    • To respond to User requests, such as contacting them regarding a question they have submitted to Utility|Pay Customer Support.

The User can revoke their consent at any time and without incurring any cost. For more information on how to proceed, please refer to the section on privacy options.

 

5. Utility|Pay shares personal data?

Utility|Pay may share the User's Personal Data or other information in various ways with third parties, as described in this section of the Privacy Statement. Utility|Pay may share Personal Data or other information for the reasons outlined below.

With other members of the Utility|Pay Corporate Group: Utility|Pay may share the User's Personal Data with members of the Utility|Pay corporate group to provide, among other things, the Services requested or authorized by the User; to manage risks; to detect and prevent potentially unlawful acts and fraudulent activities, and other violations of Utility|Pay rules and agreements, and to optimize the availability and connectivity of Utility|Pay's products, Services, and communications.

With other companies offering services to Utility|Pay: Utility|Pay shares Personal Data with third-party service providers offering services and functionalities at the direction and on behalf of Utility|Pay. These third-party service providers may, for example, provide Services to the User, verify their identity, assist with transaction processing, send advertisements about Utility|Pay products and services to the User, and handle customer support.

With financial institutions: Utility|Pay shares Personal Data with financial institutions it collaborates with to create and offer products jointly. These financial institutions may only use this information to market and offer products related to Utility|Pay, unless the User has authorized its use for other purposes. Utility|Pay may also share the User's Personal Data to process transactions, provide benefits associated with their eligible cards, and keep their financial data up-to-date.

With the User's counterparts in transactions related to the use of Services, namely other Users, partners, and service providers: Utility|Pay may share the User's information and their Account information with counterparts involved in transaction processing. Counterparts include other individuals sending money to or receiving money from the User, partners, and service providers. Information may include:

  • Personal and Account data necessary to complete the transaction;
  • Personal data to assist other participants in resolving disputes, as well as to identify and prevent fraud; and
  • Anonymous data and performance analysis to enable sellers to better understand the usage dynamics of Utility|Pay Services and improve User experiences.

With other third parties for business purposes or as permitted or required by law: Utility|Pay may share User data with third parties for Utility|Pay's business purposes or as provided or permitted by law, including:

  • if necessary to comply with the law, a legal proceeding, or applicable regulations;
  • with competent authorities or other public officials or with third parties under a subpoena, court order, or other legal process or applicable requirement to Utility|Pay or the Utility|Pay corporate group;
  • if Utility|Pay believes, in its discretion, that disclosure of Personal Data is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation into suspected or actual illegal activities;
  • to protect the vital interests of an individual;
  • with credit reporting agencies and data processing controllers to conduct global indebtedness checks and for the purposes of anti-fraud and compliance checks;
  • to investigate violations of the Terms of Use or other applicable legal conditions of any Service or to ensure their enforcement;
  • to protect the property, Services, and legal rights of Utility|Pay;
  • to facilitate a complete or partial purchase or sale of Utility|Pay's business;
  • in connection with services related to the use of a Service;
  • to facilitate risk assessment and management, as well as fraud prevention against Utility|Pay and Utility|Pay Users and fraud occurring on Utility|Pay Sites or involving the use of Utility|Pay Services, including those involving Utility|Pay business partners, strategic initiatives, or other individuals;
  • banking partners, as required by payment card association rules, for inclusion in the list of partners with whom relationships have been resolved;
  • with reporting and debt recovery companies;
  • with companies with which Utility|Pay intends to merge or from which it is acquiring; and
  • to support Utility|Pay's control, compliance, and corporate governance functions.

With the User's prior consent: Utility|Pay will also share Personal Data and other information with the User's consent or at the User's direction, including when the User authorizes linking a Utility|Pay account to a third-party account or platform.

Utility|Pay may also provide aggregated statistical data to third parties, including businesses and the public, on how, when, and why users visit Utility|Pay Sites and use Utility|Pay Services. This data does not personally identify the User or provide information about their usage of Utility|Pay Sites and Services. Utility|Pay does not share User Personal Data with third parties for marketing purposes related to such parties without the User's consent.

 

6. How does Utility|Pay interact with other services and platforms?

A significant advantage and innovation of Utility|Pay Services is the ability for the user to link their Account to a platform or a third-party account. For the purposes of this Privacy Statement, an "account linking" with a third party is a link that the user authorizes or enables between their Utility|Pay Account and another account, account, payment method, or platform not owned by Utility|Pay that the user legitimately manages or owns. If the user authorizes such linking, Utility|Pay and the third party will exchange the user's Personal Data and other information directly. Examples of account linking:

  • Linking the User's Account to a third party that deals with data aggregation or financial services if the User provides that company with access credentials to their Account; or
  • Using the User's Account to make payments or to allow charges to be debited to the User's Account.

If the user decides to link the Account, Utility|Pay may receive information about the user and their use of the third party's service. If the user links their Account to other financial accounts, directly or through a third-party service provider, Utility|Pay may access the user's account balance and transaction data, such as purchases and money transfers. Utility|Pay will use all information received from third parties through account links in accordance with this Privacy Statement.

The information that Utility|Pay shares with third parties as a result of account linking will be used and disclosed in accordance with the privacy policies of the respective third parties. Before authorizing an account linking, the user is required to read the privacy policy of all third parties authorized to link and that, by virtue of such linking, may access the user's Personal Data. For example, Personal Data that Utility|Pay shares with a platform, an account, or a third-party account, such as a social account, may, in turn, be shared with other parties, including the general public, based on the privacy policies of the account, account, or platform.

 

7. How does Utility|Pay use cookies and tracking technologies? 

When the user visits the Sites or uses Utility|Pay Services or visits a third-party website to which Utility|Pay provides online services, Utility|Pay, its business partners, and its suppliers may use cookies and other tracking technologies (collectively referred to as "Cookies") to recognize the user and personalize their online experience, the Services they use, and other online content and advertising. They also use cookies to measure the effectiveness of promotions, perform analysis, reduce risks, prevent potential fraud, and promote trust and security on Utility|Pay Sites and Services. Some aspects and features of Utility|Pay Sites and Services are only available through the use of cookies. If the user decides to disable or reject cookies, the use of Sites and Services may be limited or unavailable.

Do Not Track (DNT) is an optional browser setting that allows the user to set their preferences regarding advertiser tracking and other third-party tracking. Utility|Pay does not respond to DNT signals.

8. What options do users have with regard to privacy?

The user has several options regarding the procedures and privacy communications described in this Privacy Statement. Many of these options are explained when the user registers or when using a Service or Site. While navigating within the Services, the user may receive instructions and requests.

  • Options regarding Personal Data collected by Utility|Pay
    • Personal Data. The user can refuse to provide the Personal Data requested by Utility|Pay. In this case, however, they may not have access to some or all of the Services.
    • Location and other device-level information. The device used to access the Sites or Services may collect information about the user, including geolocation information and user usage data, which Utility|Pay may then acquire and use. For information on limiting the collection and use of such information, refer to the settings available on the device.
  • Options regarding the use of Personal Data by Utility|Pay
    • Online tracking and personalized advertising. Utility|Pay collaborates with third-party partners and service providers to serve the user advertisements using cookies and web beacons associated with advertisements. The user can explicitly refuse third-party advertising-related cookies and web beacons. In this case, Utility|Pay's advertising will not be directed at the user, but they will continue to see Utility|Pay's advertising on third-party websites.

      • For more information on third-party advertising cookies and personalized advertising, and for instructions on explicitly refusing these procedures by companies participating in industry self-regulation, refer to the User's online options section.
  • Options regarding Account linking
    • If the user authorizes linking their Account to a platform, third-party account, or account, they may be able to manage their linking preferences from their Account or from the third-party platform, account, or third-party account. For more information on available options, consult the privacy policy governing the relevant third-party platform.
  • Cookie-related choices
    • Options may be available to manage the user's preferences regarding cookies. For example, the Internet browser or device may allow the user to delete, disable, or block certain cookies and other tracking technologies. For more information, visit the AboutCookies.org website. The user may also choose to enable these options, but this may prevent the use of many of the main features available for a Service or Site.
    • An option may be available to allow the user to choose whether to allow the use of cookies or other tracking technologies when using a Service or visiting sections of a Site. For example, the user may be asked if they want the Service or Site to "store" certain information about them. Utility|Pay will use cookies and other tracking technologies to the extent permitted by the user.

  • Options regarding User Registration and Account Data
    • If the user has an Account, they can typically control and modify their Personal Data by logging in and updating the data directly or by contacting Utility|Pay. If the user does not have an Account or has questions about Account data or other Personal Data, the user can contact Utility|Pay.
  • Communication options
  • Utility|Pay Communications, Notices, and Updates: 
    • Marketing: Utility|Pay may send the user marketing content regarding its Sites, Services, products, products offered in conjunction with financial institutions, as well as products and services of independent third parties and members of the Utility|Pay corporate group through various communication channels, such as email, SMS, pop-ups, push notifications, and messaging applications. The user can choose to stop receiving such marketing communications from Utility|Pay by following the instructions in the communications themselves. If the user has a Utility|Pay Account, they can also change communication preferences in the Account Settings. Regarding messages sent through push notifications, the user can manage preferences on their device.
    • Information and others: the user will receive all necessary communications that Utility|Pay is required to send to users of its Services, notifications containing important information, and other communications requested by the user to Utility|Pay. The user cannot choose not to receive such communications, but they can change the means and format in which they receive them.

 

9. What are the user's rights?

In accordance with the limitations established by the data protection regulations of the European Economic Area, the user holds certain rights regarding their Personal Data. In particular, the user has the right of access, rectification, limitation, deletion, and data portability. To exercise these rights, the user can contact Utility|Pay.

Furthermore, subject to certain specific requirements, the user has the right to object to the processing of their Personal Data based on legitimate interests or a public interest or the exercise of public authority vested in Utility|Pay.

If the user has an Account for one of the Utility|Pay Services, they can generally control and modify their Personal Data in the Account by logging in and updating the information directly. Utility|Pay may use automated decision-making processes for credit-related matters with the prior consent of the user, where necessary for the conclusion or performance of a contract, or where authorized by a law of the European Union or a member state of the European Union.

10. How does Utility|Pay protect your personal data?

Utility|Pay employs technical, physical, and administrative security measures designed to ensure adequate protection of the user's Personal Data against loss, misuse, unauthorized access, disclosure, and alteration. These security measures include firewalls, data encryption, physical access controls to Utility|Pay data centers, and verification of access authorizations to information. Although Utility|Pay is committed to protecting its systems and services, the user is responsible for safeguarding and maintaining the privacy of their passwords and Account or profile registration data, as well as ensuring that their Personal Data acquired by Utility|Pay is correct and up-to-date. Utility|Pay is not responsible for the protection of Personal Data shared with third parties as a result of an account link authorized by the user.

 

11. What else needs to be known?

Changes to this Privacy Statement. 

Utility|Pay may periodically update this Privacy Statement to reflect any changes to its Sites, Services, and operations, as well as changes in applicable laws. The updated Privacy Statement will be effective from the published effective date. 

If the updated version includes a material change, Utility|Pay will communicate it 30 days in advance by posting a modification notice on the "Rule Updates" page of the Utility|Pay website. Utility|Pay may also inform Users of the change via email or another tool. 

 

12. Definitions

  • Account: a Utility|Pay user account.

  • Data Controller: Utility|Pay determines the purposes and means of processing Personal Data.

  • Device Information: data that may be automatically collected from any device used to access the Site or Services. This information may include, for example, the type of device, device network connections, device name, device IP address, information about the web browser and Internet connection of the device used to access the Site or Services, Geolocation Information, information about apps downloaded to the device, and biometric data.

  • Geolocation Information: information indicating the User's location with reasonable specificity, such as latitude and longitude coordinates obtained through GPS, Wi-Fi, or cell site triangulation.

  • Utility|Pay: refers to Utility|Pay, Inc. and its affiliates or subsidiaries. In this Privacy Statement, Utility|Pay is sometimes referred to in the first person plural, depending on the context.

  • Personal Data: information that can be associated with an identified or directly or indirectly identifiable individual. "Personal Data" may include, for example, name, address (including billing and shipping addresses), telephone number, email address, credit or debit card number, other account-related financial data, account number, date of birth, and credentials issued by authorities (such as driver's license number, identity document number, or passport number).

  • Process: any method adopted by Utility|Pay to manage Personal Data or sets of Personal Data, with or without the aid of automated processes, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval and consultation, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction of Personal Data.

  • Services: any product, service, content, feature, technology, or functionality, as well as all related websites, applications, and services offered to the User by Utility|Pay.

  • Sites: the websites, mobile apps, official social media platforms, or other online properties through which Utility|Pay offers the Services and where this Privacy Statement is directly published or available via a link.

  • Technical Usage Data: data collected from the phone, computer, or other devices that the user uses to access Utility|Pay Sites or Services. Technical Usage Data shows how the user uses Utility|Pay Sites and Services, such as what the user searches for and views on the Sites and how the user uses Utility|Pay Services, including IP address, statistical data about page loading or viewing, websites visited before visiting Utility|Pay Sites, and other data related to usage and navigation collected through cookies.

  • User: an individual who uses the Services or accesses the Sites.

 

13. Google ReCaptcha

Utility|Pay uses ReCaptcha on the Sites and Services. The use of ReCaptcha is subject to Google's Privacy Policy and Terms of Service.

ReCaptcha is used solely to prevent spam and improper use.
